Abstract
The government officers liabilities under the 1996 Act of Tort Liability include the following
performances. 1 A government officer, who performed a violated action that is not caused by the State
duties, is forced to individually reimburse the compensation according to the Civil and Commercial Code.
2 In case of the government officers violation affected by the State duties, the State Agency must reimburse a
compensation for the victim. The State authority can take the recourse from the government officer when it
revealed that the government officer performed the violation by purposely or severely negligence only. In
addition, if several government officers took part in such an infringement action, each person liability
depends on the degree of individual defects. For this result, the principle debtor condition cannot be used to
apply. 3. The amount of the liability reimbursement, assigning the liability or the amount of money that the
government officers were forced to repay; the State Agency must consider according to the severity degree
of the action and fairness criteria. However, the government officers might not pay in the full amount of any
damages. Moreover, if the violation is caused by the fault or defect of the State Agency or operating
systems, the share of the liability issue would be deducted.
